Terms & Conditions for Using GanttPad

1. Acceptance of Terms

By accessing or using GanttPad (the "Service"), operated by Andrii Sassa, Individual Entrepreneur (registration number: 3573110073), registered in Ukraine with the registered address at Pavla Tychyny Ave. 28, 109, Kyiv, 02152, Ukraine ("we", "our", "us"), you agree to be bound by these Terms of Service ("Terms"). When you use the Service, you are contracting with Andrii Sassa, Individual Entrepreneur. If you do not agree to these Terms, you may not use the Service.

2. Description of Service

GanttPad is a web-based project management tool that provides Gantt chart creation, task management, dependency tracking, project exports (PDF, Excel, Google Drive), and related features. The Service is available in free and paid tiers, each with different feature limits as described on our pricing page. Export and integration features are available to all users regardless of plan.

3. User Accounts

You must create an account to use the Service. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must provide accurate and complete information when creating your account and keep it updated.

4. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose
  • Attempt to gain unauthorized access to the Service or its related systems
  • Interfere with or disrupt the integrity or performance of the Service
  • Upload malicious content or code
  • Resell, sublicense, or provide the Service to third parties without our written consent
  • Use automated means to access the Service beyond what is provided by our API

5. Intellectual Property

The Service, including its original content, features, and functionality, is owned by Andrii Sassa, Individual Entrepreneur, and is protected by international copyright, trademark, and other intellectual property laws. You retain ownership of the content you create using the Service.

6. Your Data

You retain all rights to the data you input into the Service. We claim no ownership over your project data, task content, or other materials you create or upload. You grant us a limited license to host, display, and process your data solely to provide the Service to you.

7. Payment and Billing

Certain features of the Service, including all export options (PDF, Excel, Google Drive) and third-party integrations, are available free of charge to all users. Paid plans provide additional capabilities such as higher project and task limits, and are billed in advance on a monthly or annual basis.

Our order process is conducted by our online reseller Paddle.com. Paddle is the Merchant of Record for all our orders: when you purchase a paid plan, you are buying from Paddle, which handles payment processing, collection and remittance of applicable sales tax and VAT, invoicing, and billing support. Your purchase is subject to Paddle's Checkout Buyer Terms, which govern billing frequency, renewals, payment terms, and taxes.

We reserve the right to change pricing with 30 days' notice. If you cancel a paid subscription, you will retain access to paid features until the end of your current billing period. All prices are displayed inclusive of applicable taxes where required by law.

8. Refund Policy

If you are not satisfied with your purchase, you may request a full refund within 14 days of the transaction date, without needing to provide a reason. This is in accordance with your rights under EU consumer protection law. The full policy is set out on our Refund Policy page.

To cancel a subscription, you may do so at any time through your account settings or by contacting us. Cancellation will take effect at the end of your current billing period, and no further charges will be made.

For refund requests, please contact us at [email protected] or contact Paddle, our merchant of record, directly at paddle.net. Refunds are processed by Paddle to the original payment method, typically within 5–10 business days.

9. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted access. We may temporarily suspend the Service for maintenance, updates, or circumstances beyond our control. We will provide reasonable notice of planned downtime.

10. Limitation of Liability

To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly. Our total liability for any claim arising from or related to the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

11. Termination

We may terminate or suspend your account at any time for violation of these Terms. You may delete your account at any time. Upon termination, your right to use the Service will cease immediately, and we will delete your data in accordance with our Privacy Policy.

12. Third-Party Integrations

GanttPad offers optional integrations with third-party services, including Google Drive. By using these integrations, you acknowledge and agree that:

  • The Google Drive integration is entirely optional and is not required to use the Service
  • GanttPad is not affiliated with, endorsed by, or sponsored by Google LLC
  • When you export project data to Google Drive, you are responsible for managing the files created in your Drive, including any storage limits imposed by Google
  • GanttPad is not liable for any data loss, corruption, or unavailability within Google Drive or any other third-party service
  • Your use of Google Drive is subject to Google's own Terms of Service and Privacy Policy
  • You may disconnect the Google Drive integration at any time from your account settings or by revoking access at myaccount.google.com/permissions

13. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the Service after changes constitutes acceptance of the updated Terms.

14. Governing Law

These Terms are governed by and construed in accordance with the laws of Ukraine. Any disputes arising from these Terms or the Service shall be resolved in the competent courts of Kyiv, Ukraine. If you are a consumer in the European Union or another jurisdiction with mandatory consumer protection laws, you retain the protections afforded by those laws and the right to bring proceedings in the courts of your country of residence.
